Liberty Lake Condominiums

These are the rules for the association, a revision to these rules will be made in early 2009

General Rules

 

       A1.1   All residents are required to have a current resident information form on file at the resident

       managers office. This information is important in case of an emergency.

 

       A1.2   All residents are responsible for the conduct of their family members and their guests, inside and

       outside of their unit.

 

       A1.3   No unit or common areas shall be used in a fashion which interferes with other residents.

 

       A1.4   No smoking in the stairs wells. If you smoke on your deck you must use a fire safe ashtray.

 

       A1.5   Residents shall exercise extreme care in making noises, particularly the use of musical instru-

       ments, radios, tools, televisions or amplifiers that may disturb other residents. No outside amplifiers,

       radios or speakers anywhere that are audible at a distance of more than 5 feet will not be allowed.

 

       A1.6   No loud noise of any kind will be tolerated between 10P.M. and 8A.M.

 

       A1.7   All acts of vandalism, littering, etc., should be reported to the resident manager.

 

       A1.8   Liberty Lake is strictly a residential condominium. There will be no permanent or temporary

       commercial business in the complex

 

       A1.9   No signs of any kind are to be posted in a unit window or elsewhere on the property except for

       the bulletin boards located in the laundry rooms.

 

       A1.10   Firearms, air rifles, slingshots, fireworks, etc., shall not be displayed or discharged in any area

       of the Liberty Lake Condominium complex.

 

A1.11  Any form of threatening action, be it verbal or physical, towards management, members of the Liberty Lake staff or Board of Directors will result in an immediate fine.

 

Buildings and Grounds

 

      A2.1   Feeding the ducks and geese in the lake or on the grounds is forbidden.

 

        A2.2  The entryways, paths, stairs and area under the stairs must remain clear at all times and shall not

        be used for storage as it violates the local Fire and Safety Codes.

 

        A2.3   Bicycles are not to be left on the grounds, walkways, parking areas or other common areas.

        They are not to be stored under the stairs. All bike must kept in good working condition.

 

        A2.4   Patios and balconies are not to be used to store boxes, containers or other items.

 

        A2.5   Flower displays in proper containers are encouraged but must be secured to balcony rails so

        they don’t fall off. Deck furniture in good condition is also encouraged.

 

        A2.6   Watering of plants and sweeping of balconies must be done in a manner that will not create a

        nuisance to the residents living in lower units.

 

        A2.7   Garments, rugs, blankets, etc., will not be hung from railings, windows or the facade of any

        unit or building.

 

A2.8   Balconies and patios must be kept neat and clean at all times. All residents are responsible for keeping the landing outside their front door clean.

 

        A2.9   All window coverings must be an off-white color as seen from the exterior. No plastic sheeting,

        bed sheets or blankets are a allowed for window covering. All window coverings/blinds viewed from the outside are to be kept in good condition and blinds cannot be bent or broken.

 

        A2.10  Residents are responsible for reporting any leaking faucets, running toilets or other malfunc-

        tions to the resident manager or the units owner’s. Otherwise, the resident or unit owner, may be res-

        ponsible for any resulting damage caused by the malfunction to other units or the common areas.

 

        A2.11  Any damage caused to the common areas by the resident, their guests, mover, or employees

        moving articles in or out of a unit shall be paid for by the unit’s resident/owner..

 

        A2.12  The management reserves the right to enter and inspect any unit for damage, or possible

damage, that may have been caused by that unit or to that unit or to that unit by another.

 

Parking

 

       A3.1   All resident-owned vehicles parked on Liberty Lake Condominium property must have a

        current vehicle registration sticker on their license plate and display a Liberty Lake vehicle regis-

        tration tab obtainable from the resident manager, if not they will be towed at the owner’s expense.

 

        A3.2   The covered parking stalls are owned or rented by residents. Any vehicle parked in a unau-

        thorized stall will be towed.

 

        A3.3   Vehicles that are not in operable condition shall not to be parked on the property and are subject to being towed at the vehicles owner’s expense.

 

        A3.4  Any permit for more than two vehicles per unit will be at the discretion of the resident manager

        and if so allowed the resident will be charged $30.00 per month per additional vehicle.

 

        A3.5  Carports and parking areas shall be maintained in an orderly condition and free of all oil

  droppings. Vehicles with loud mufflers or excessive oil leaks are not to be kept on Liberty Lake property.

 

A3.6  All visitors to Liberty Lake must park in the visitor parking areas. It is the residents responsible to inform their guest/visitors where they should park so that their vehicle will not be towed.

 

Vehicle Maintenance

 

       A4.1  Vehicle maintenance may not be performed on complex property. Oil and antifreeze changes

        or any other maintenance is not allowed.

 

         A4.2  Washing of cars, motorcycles and boats on Liberty Lake property is forbidden.

 

Swimming pool

 

        A5.1  The swimming pool is to be used only by residents and their guests. Each unit is limited to

          having two (2) guests at a time in the pool and pool area.

 

          A5.2  No guests will be allowed in the pool or pool area unless accompanied by the unit resident

          that they’re visiting.

 

          A5.3  No children under the age of 16 will be allowed in the pool or pool area without a supervi-

          sing adult present at all time.

 

          A5.4  As a courtesy to the residents who reside next to the pool, during the hours from 7.00PM

          to 10PM the noise un and around the pool is to be kept to a low level.

 

          A5.5  No glass containers of any kind are allowed in the pool area.

 

          A5.6  Only proper swimming attire is to be worn in the pool. No cut-offs or diapers.

 

A5.7  Only those residents that have a special pool/cabana key can enter the pool area unless they are a  guest of another tenant. See the resident manager to get a key. There is a $25.00 deposit for each key.

 

C a b a n a

 

        A6.1  The cabana, spa and saunas are for the use of the residents and their guests only. All

          persons under the age of 18 must be accompanied by adult resident at all time.

 

          A6.2  Residents and their guests using the cabana, spa and saunas are responsible for clea-

          ning up after using these facilities.

 

          A6.3  The cabana is available for private parties of 25 or less. Reservations can be placed with

          the residents manager. All party reservations must be confirmed within seventy-two (72) hours

          of the event or the date will be declared open. A fifty ($50) rental fee plus a one hundred

          and fifty ($150) deposit is required for any private party. The deposit will be refunded if the

          facility is returned to a proper degree of cleanliness. All cleaning must be completed prior to

          12:00 noon the following day. Cleaning instructions and a copy of the cabana house rules will

          be issued at the time the reservation is placed.

 

          A6.4  Cabana parties are limited to the interior of the cabana and its lakeside deck. The resident

          host or hostess must remain with their guests at all times. All parties must be out of the cabana

          by the 10P.M. lock up time.

 

Children

 

        A7.1  Children are not allowed to play in the parking areas, entryways/stairwells, flower beds, barked areas or on the rock retaining wails.

 

          A7.2  Adult residents and parents are responsible for all minors and children under their custody

          anywhere on the premises.

 

Pets

 

         A8.1  All residents must understand that there is a delicate balance between the privilege of having

           a pet and the rights of other residents to use and enjoyment of the property. Therefore the limitation

           on having a cat or dog at Liberty Lake in only one (1) cat or one (1) dog in any unit.

 

           A8.2  No household pet shall be kept in a unit whose weight is more than twenty (20) pounds.

 

           A8.3  All dogs must be kept on a leash at all times when outside of their unit.

 

           A8.4  Dog owners are to clean immediately any defecation by their pet. Dog defecation must

           be put in a plastic bag before it is placed in the trash dumpster.

 

           A8.5  No pets shall be penned or tethered outside of the unit. This includes the patios, decks

           and stairwells.

 

           A8.6  No pets is allowed in the cabana, its deck or in the swimming pool/swimming pool area.

 

           A8.7  Any pet who endangers the physical safety of a resident can be declared a nuisance and

           will be removed from the property immediately, In addition to these rules, all other county and

           city regulations pertaining to animal control are incorporated in these rule and apply to all residents.

 

           A8.8  All dogs and cats must have a current King County license.

 

 

Dumpsters & Garbage

 

         A9.1  Trash containers are always available. No “temporary” trash is to be left outside of your unit.

 

           A9.2  Large items such as furniture, mattresses. etc., must be removed from the property and

           taken to the dump at the residents expense and not left in the dumpsters.

 

           A9.3  Cardboard boxes must be flattened and placed in the recycling dumpster - not alongside.

 

           A9.4  The blue recycling bins are for recyclable items only and are not be used for other types of

           trash.

 

Hazardous   Matter

 

         A10.1  No toxic, noxious or flammable materials will be put into the dumpsters. This is a very

           serious offense and if any of this material is found in the dumpsters it should be reported to the

           Fire Department immediately.

 

           A10.2  No combustible material will be kept within unit or common area that will endanger the

           premises.

 

Insurance

 

         A11.1  Association Responsibility. The insurance of the buildings, common property and

liabilities arising from claims against the Association is provided for in the Association’s Master

           Policy.

 

           A11.2  Residents Responsibilities. All residents are responsible for personal property loss and

           liability not covered by the Association’s Master Policy.

 

           A11.3  The Board of Directors or the Association shall not be held responsible for personal property nor deliveries left in the common areas and facilities or any other place on the premises, nor

           for any articles left with an employee.

 

Lease and Rental Agreements

 

         B1.1   Any lease or rental agreement must provide that its terms shall be subject in all respects

           to the provisions of the Declarations, Bylaws, and Rules and Regulations of the Association.

           Any failure by the tenant to comply with the terms of such obligations shall be in default under

           the lease or rental agreement. Each unit owner has the obligation to enforce the terms of the lease

           executed with the tenant.

 

           B1.2   Owners must screen their prospective tenant an provide a copy of such report to the resident

           manager for approval. Owner must also use a rental agreement that is pre-approved by the HOA.

           Failure to screen tenants, get manager approval of prospective tenant and/or use pre-approved rental

agreements will subject owners to a $200 fine per occurrence in addition to any other damage resulting from such failure.

 

           B1.3   All new residents must report to the resident manager’s office within 5 days of moving in to

           be given a copy of these Rules and Regulation as well as other information pertaining to the complex.

It is the unit owner’s responsibility to assure their new tenants comply with this rule. Failure for them to do so will result in a $75.00 fine being issued to the unit owner.

 

          B1.4   There will a move-in fee charged to the owner of a unit anytime there is a new move-in to

          their unit. This includes a new rental tenant as well as a new owner. The amount of the move-in fee

          is $50.00.

 

          B1.5   No unit shall be rented for transient or hotel purposes. Any lease must be of at least six (6)

          month’s duration. A lessee may not sublet or allow a third party to occupy the unit without owner

          and resident manager’s approval.

 

          B1.6   Owner not residing on the property and renting their units transfer use of all amenities to their

          tenant.

 

          B1.7   The electricity to a unit will never be disconnected or the breakers placed in the off position by

          the resident or owner except for repair, in an emergency or in the case that rule B2.5 Step 4 should

          apply.

 

          B1.8   No illegal use shall be made of any portion of the premises.

 

          B1.9   Owners or renters must not install anything which intrudes into or affects the common areas or

          will impair the structural integrity of a building unless authorized by the Board of Directors. This

          includes windows, awnings, canopies, shutters, radio or television/TV dish antennas as well as plant and landscaping in the common areas.

 

B1.10  Upon selling or transferring their ownership of a covered parking space the owner must, within 30 days, notify the managing agent of this transaction.

 

B1.11  All unit owners must have on file with the resident manager and the managing agent their correct mailing address as well as a phone number at which they can be reached. This information is very important should an emergency arise involving their unit.

 

Administration

 

B2.1   The Governing Board has the power, authority and duty to supervise the management and maintenance of the condominium as provided and specified in the Declarations. The managing agent will act in an advisory capacity as needed and requested by the Governing Board.

 

           B2.2   The resident manager is an employee of the Governing Board. They perform their duties as

           out lined in their job description.

 

           B2.3   Assessments. In accordance with the Declaration, the Board of Directors shall estimate the

net charges to be paid during the following year. If said sum estimate proves inadequate for any reason, the Board of Directors may at any time levy a special assessment.

 

           B2.4   Payments. Each owner shall be obligated to pay all assessments on or before the fifteenth (15th)

day of each month for the current month’s assessment.

 

        

          

B2.5   Schedule of Collection Action: While this section applies only to owners, renters should be

           aware of the action that could result in Step 4.

 

                     

        Step 1.               1st day of the month – payment is due.

 

                      Step 2.                If not received by the 15th day of the month – payment is late. A thirty-five

                                                  dollar ($35.00) late fee will be added to the amount due.

 

                       Step 3.                 30th  day of the month the managing agent will send a letter requesting payment.

 

                      Step 4.                10th day of the second month – letter from the managing agent that a lien 

                                                  has been filed. Copy sent to delinquent owner’s lender. Letter from mana-

                                                  ging agent giving notice that if payment is not received in full within ten

                                                  (10) days. They may cut off or cause to be cut off any utilities they deem

                                                  necessary to the delinquent owner’s unit.

 

                       Step 5.                 30th day of the second month – Court action maybe initialed either in a

                                                   small Claims Court or in a Superior Court to seek judgment for full pay-

                                                   ment of past assessments, late fees and collection expenses (i.e., filing fees,

                                                   service fees and attorney fees).

 

Rules Enforcement Procedures

 

         All unit owners have the responsibility of making sure their family members, their guests, renters     

           and their family members and guests abide by all of the Liberty Lake Condominium Rules and

           regulations.

 

           Fist violation* A written warning notice will be issued to the unit’s resident by the resident

manager or other authorized person or persons. A copy of this notice will be sent to the unit’s owner

if different from the resident, and to the managing agent.

 

Second and subsequent violations for same offense – A monetary penalty, as stated below, for

the second and all subsequent violations, will be added to the unit owner’s next monthly assessment and legal steps will be taken to collect the accumulated fines and to correct the violation. All costs of collection, including actual attorney’s fees incurred, will be borne by the owner and/or the resident found in violation of the rules. Also, see Step 4 above under Schedule of Collection Action.

 

           If any owner, feels that any notification of any violation has been issued in error or wishes to con-

           test such notice, they have the right to appeal by writing a letter to the Board of Directors stating their

           grievance and documenting how they feel the notification or penalty was in error. A committee

           established by the Board of Directors will review all owner grievances and will notify the owner of

           their decision to allow the penalty to be enforced or to drop it. The owner has 25 days from the time

they receive the notification of a penalty to notify the Board in writing of their grievance or the penalty phase will proceed as outlined in these Rules and Regulations. Failure to so notify the Board of the grievance will be a waiver of any right to future appeal of the penalty.

 

Monetary  Penalties

 

All monetary penalties are as follows unless listed bellow as a special fine. The penalties are $100.00 for the second violation and then double (ex: 3rd violation - $100 to $200, 4th violation - $200 to $400,

5th violation - $400 to 800 etc.) for each subsequent violation of the same rule to a maximum fine of $400.00. The penalties will then continue to accrue at this level until the violation is corrected.

 

          

Special fines for all residents/owners:

 

                        A1.9  Firearms, air rifles, slingshots, fireworks, etc.             $250 for each violation.

 

                        A1.10  Threatening actions toward management/staff           $100 for each violation,

 

                        A2.1  Feeding the ducks and geese                                        $100 for each violation.

 

.                       A9.2  Large items left in trash, by the trash bins                   $75 for each violation (each over-

                        or elsewhere on the grounds of the complex                         sized item)plus the cost of disposal.

                        

         A10.1  Toxic, noxious or flammable materials in trash.        $250 for each violation plus cost

                                                                                                                       of disposal.

 

                        A10.2   Combustible materials in units or common area.    $250 for each violation plus cost

                                                                                                                       of disposal.

 

          

 These special fines apply only to unit owners:

 

                          B1.2    Failure of owner to screen tenants                           $200 for each violation.

 

                          B1.3    New tenant failing to report to office                      $75 starting after 5 days.

 

                          B1.9    Owner’s emergency information                             $100 starting 15 days after

                                                                                                                        notification.

 

 

* Exception to the first violation rule When the resident/property manager determines that a violation to rules and regulars is so grievous that it warrants an immediate action, the first violation warning notice rule will not apply and a fine will be issued immediately.
